Terms of Service

By creating an account or using Elevayt (operated by Elevayt Technologies Pvt. Ltd.), you agree to these Terms of Service. If you do not agree, do not use the platform.

You must be at least 18 years old and a resident of India to use Elevayt. By using the platform, you represent that you meet these requirements and are using the platform for legitimate business purposes.

You agree not to use Elevayt to:

• Send spam, unsolicited bulk messages, or harass users
• Violate WhatsApp Business Policy or Meta Platform Terms
• Impersonate another business or individual
• Engage in illegal activities, including fraud, money laundering, or unlicensed financial services
• Attempt to reverse-engineer, scrape, or disrupt the platform
• Use the platform to generate content that violates applicable laws, including defamation, hate speech, or content harmful to minors

We reserve the right to suspend accounts that violate these terms, with or without prior notice depending on severity.

Elevayt offers a Free Preview plan and paid subscription plans (Starter, Growth, Pro) billed monthly in INR through Razorpay.

Renewal: Paid subscriptions renew automatically on the same date each month. You authorize Razorpay to charge your payment method on renewal.

Cancellation: You can cancel at any time from Dashboard → Billing. Access continues until the end of your current billing period. No partial refunds are provided for unused time in the current cycle.

Failed payments: If payment fails, we will retry 3 times over 7 days and notify you via WhatsApp and email. After 10 days of failure, your account enters grace mode (website remains live; AI agents pause). After 30 days, data is retained for 6 months before deletion.

Plan changes: Upgrades take effect immediately (prorated). Downgrades take effect at the end of the current billing cycle.

Taxes: All prices are exclusive of applicable GST. GST will be added at checkout at the applicable rate.

Your business data belongs to you. This includes your business information, client records, booking history, and content you create on the platform. You can export or delete this data at any time.

We own aggregated insights. Anonymized, aggregated operational patterns derived from platform usage (e.g., average booking rates, content performance benchmarks) belong to Elevayt and are used to improve the platform for all users. These insights are not attributable to any individual business.

You grant Elevayt a limited license to use your business data solely to provide the platform services described in these terms and our Privacy Policy.

Elevayt uses AI (including Anthropic's Claude models) to generate website copy, social media content, WhatsApp messages, and other materials. You are responsible for reviewing and approving any AI-generated content before it is published or sent to your clients.

AI-generated content is not guaranteed to be accurate, complete, or free from errors. Elevayt is not liable for any consequences arising from AI-generated content used without review.

To the maximum extent permitted by applicable law, Elevayt's total liability to you for any claims arising from use of the platform is limited to the amount you paid for the platform in the 3 months preceding the claim.

Elevayt is not liable for: indirect, incidental, or consequential damages; loss of business, revenue, or data; service interruptions; or any third-party acts (including WhatsApp, Google, or Razorpay outages).

Elevayt does not guarantee that the platform will be available 100% of the time or that AI-generated content will meet your specific requirements.

Your use of WhatsApp features through Elevayt is subject to Meta's WhatsApp Business Policy. We cannot guarantee continued access to WhatsApp APIs, as Meta may change access terms at any time.

Similarly, Google Business, Instagram, and other integrations are subject to their respective platform policies. Elevayt is not responsible for changes to third-party platforms that affect functionality.

You may delete your account at any time from Settings. Upon deletion, your PII is removed within 72 hours; your website is taken down; and data is retained for 6 months before complete purge (see Privacy Policy for details).

We may terminate or suspend your account if you violate these Terms, with notice where practicable.

We may update these Terms at any time. For material changes, we will notify you at least 14 days in advance via email or in-app notification. Continued use after the effective date constitutes acceptance of the updated Terms.

These Terms are governed by the laws of India. Any disputes shall be resolved in the courts of jurisdiction applicable to the registered office of Elevayt Technologies Pvt. Ltd.
